What to Know About Pregnant Workers Rights

Too many women workers get held back in their jobs or careers ­because of pregnancy. Bias against mothers comes from corporate culture that favors unencumbered workers.

The Pregnant Workers Fairness Act went into law in June 2023. It expands the protections for women. It requires that employers provide reasonable accommodations for pregnant workers. Pregnancy and postpartum are vulnerable times for most women. Their tolerance for stress is lower, while their need for income and job security is high. Women need additional support at work.

Examples of accommodations include a flexible schedule, more breaks, modified duties, a chair or a comfortable work station. A woman should notify their employer as soon as she is comfortable doing so. Many symptoms of pregnancy that interfere with work begin in the first trimester – for example nausea and fatigue.

Early notice to the employer can avoid employer retaliation. The new law does not protect a woman until she notifies the employer of her pregnancy.
